General conditions of sale
1, OBJECT
These general conditions of transaction (in ahead, the "General Conditions") regulate the transaction online of products offered to the public by BABYTRAIN through our VIRTUAL STORE
2, ADHESION To The GENERAL CONDITIONS
The complementation and shipment of the Order of purchase express the total adhesion and without reserves to all and each one of the General Conditions, so and as Acceptance is indicated in the square "the General Conditions" of the Order of purchase.
3, ORDERS
The Orders of purchase will be attended solely by means of electronic means from BABYTRAIN.ES or BABYTRAIN.CAT, indeed with use of the average technicians there ready to the effect, properly complimented and, in individual, having itself completed entirely the spaces in target and having itself provided all and each one of the data asked for like obligatory.
Once received an Order of purchase, BABYTRAIN will send of form immediate a confirmation of the order to the indicated direction of electronic mail in the Order of purchase.
All the products take built-in an informative traffic light about the availability of the same one. The meaning of the colors is detailed here;
RED LIGHT: No available. To consult availability in info@babytrain.es
YELLOW LIGHT: Available in 10 - 15 days
GREEN LIGHT: Available
Still, in the assumption that at the moment of reception of an Order of purchase del were not available stock Product or Products object of this Order, BABYTRAIN will offer al Client the possibility of hoping to that it is received from his supplier, to acquire a similar Product or of ANNULLING the Order of purchase.
4. PAYMENT FORM
4.1. Price
The price of Products will be paid exclusively, and to election of the Client, by anyone of following ways:
(a) By credit card (RECOMMENDED). The service of payment by means of credit card is provided directly by the Caixa. BABYTRAIN excludes all responsibility in relation to the confidentiality and security from the information and data provided by the Client with occasion of the payment of their electronic purchases by means of credit card, in the measurement in which the treatment of this information and data is not exclusively under the BABYTRAIN control
(b) By bank transfer to the account number (Swift code / Bic code CAIXAESBB and IBAN account from La Caixa ES 95 2100 0415 01 0200257654). In this case, the customer will have to indicate the total amount of his purchase, the beneficiary (BABYTRAIN S.C.) and the concept "PURCHASE IN BABYTRAIN" and the number of the Order of purchase assigned when making the operation of purchase. Once made the entrance, it will have to send the voucher by fax to n° 0034 902 027 162, indicating the bench mark of the Order of purchase
4.2. Expenses and taxes
The expenses of preparation, packing and shipment of bought Products, as well as, in their case, the IVA and other taxes that are of application, are on behalf of the Client, who will come to pay them along with the price and in the same chosen form to make cash the payment of the price.
4.3. Guarantees on the payment
For the case that the Client chose the payment against reimbursement as mode of payment of the price, applicable expenses and taxes, BABYTRAIN reserves the right to demand that the Client lends the opportune guarantees of payment before sending the Confirmation and giving course to the received order, taking care of for it the risks to which foresee ably it is exposed, like, for example, the incidences had with occasion of other previous payments or the existence of financial information that therefore advise it.
4.4. Moratorium interests
In case of Moor in the applicable payment of the price, expenses and taxes, the Client will come forced to satisfy to BABYTRAIN an interest with four delay equivalent to (4%) monthly on the amount owed, calculated from the date in which she to date overcame the obligation of payment by virtue of the corresponding invoice in which this one completely is satisfied.
5, DOMINION RESERVE
BABYTRAIN specifically reserves to the dominion of the Product until the complete payment of their price applicable expenses and taxes, as well as I interest moratorium.
6. IT GIVES OF THE PRODUCT
6.1. Term
The downtime of products IN STOCK, will be of between ONE and TWO working days, from the moment at which it becomes the effective collection of the totality of the price, applicable expenses and taxes. For the assumptions in that the product had to ask for itself to the BABYTRAIN suppliers, the mentioned downtime previously it will be understood from the moment of the reception of the merchandise in the BABYTRAIN warehouses. BABYTRAIN declines all responsibility in case of benefit impossibility del Service, if it must to any assumption of force greater or act of God.
6.2. Zones of delivery
BABYTRAIN gives their products within the Spanish state, in the Peninsula, Baleares and the Canary Islands; as well as in the rest of the world (to consult).
6.3. Transmission of risks
The delivery is made by means of the make available of the Product by BABYTRAIN or by third on behalf of BABYTRAIN in the direction indicated by the Client in the Order of purchase. The Client will assume all the risks of deterioration, reduction, damages and loss of Products from the moment at which the Products had been made their available in accordance with this clause.
7, RESPONSIBILITY BY DELIVERY
BABYTRAIN will be released of the fulfillment of their anticipated obligations of delivery in Clause 5 and on the matter declines all responsibility in the following assumptions:
(a) Total or partial non-payment by the Client accompanying at your service by Purchase, safe in the modality of payment against reimbursement.
(b) Omission or inaccuracy of the information that, in accordance with previous Clause 3, must provide the Client in the Order of purchase to the time to carry out the order.
8, GUARANTEE OF PRODUCTS
At the moment of the make available of the Product, BABYTRAIN will make delivery to the Client of the documentation of guarantee offered by the manufacturer of the Product. Once received, the client will have to compliment correctly and to give back it by ordinary mail to BABYTRAIN that will also come to his sealed and later return by mail.
9. STRAIGHT OF DROPPING OF THE CLAIM
9.1. Form and term of exercise
The Client will be able to stop freely of the contract within the counted term of seven (7) days from the date of delivery according to previous Clause 6, 2. The date of the defense accreditation of the delivery will serve with the object of calculation of the term of seven (7) days referred in this Clause 9.1.
The exercise of the dropping of the claim right will not be subject to formality some, being enough that is credited in any form admitted in Right.
However, the Product will have to be in new state and its original packing or, in its defect, properly sprinted by its own means; and along with he, the original one of the invoice that at its moment had sent BABYTRAIN to the Client. The risks of loss, deterioration, reduction or damage of the Product to which the dropping of the claim talks about, are of position of the client until their delivery to BABYTRAIN. The exercise of the right of dropping of the claim on the part of the Client will not imply the penalty imposition some.
9.2. Reimbursement in case of dropping of the claim
BABYTRAIN will reimburse to the Client the amount satisfied initially by this one (once deduced the direct expenses of return, that will be on behalf of the Client rejecting itself the returns to bearings due) for applicable price, expenses and taxes by the Product in a maximum term of fifteen (15) days after the reception of the Product by BABYTRAIN, as long as the Product was received by BABYTRAIN in the conditions established in previous clause 9,1. In case the given back Products had some flaw, the Client will have to compensate to BABYTRAIN by the amount corresponding to such flaws, being deduced this amount of which there was to return to the Client as a result of the dropping of the claim. The reimbursement to which the previous paragraph talks about will take place by means of installment in its credit card.
9.3. Exceptions to the dropping of the claim right
By exception, the dropping of the claim right will not be of application in the following assumptions:
(a) when the Product can be reproduced or be copied with immediate character (sonorous recordings, of video computer science text books, documents in general, or programs, that had been unsealed by the Client);
(b) when one is Products destined to the corporal hygiene;
(c) when they are Infantile Arresting gears for the automobile (chairs of security, elevators, shopping baskets of security, etc).
(d) In general, when it is Products that, in regard to their nature, cannot be given back or can be deteriorated or expire quickly.
10, RETURNS
BABYTRAIN takes responsibility of the quality of their products, and admits the return of any defective Products, becoming position of the expenses caused as a result of such return whenever the Client communicates this circumstance in the counted term of 7 days from the date of delivery according to previous Clause 6.2.
In case of defective shipment, the return of the product to its origin will be the responsibility of the company of transport in a term of 48 h, but the bearings will be the responsibility of the client.
11, PERSONAL DATA PROCESSING
The Client authorizes to BABYTRAIN to deal with automated form his personal data. The Personal Data for the uses and with the purposes as well as under the defined conditions in their Policy of Protection of Data will treat automatized.
By means of the complementation and shipment of the corresponding Order of purchase, the User accepts that their Personal Data are object of treatment automated on the part of BABYTRAIN in the terms indicated in the Policy of Protection of Personal Data of BABYTRAIN.
12, COMMUNICATIONS
12.1. Way to carry out them
All communication between Client and BABYTRAIN relative to a certain order will be able to become or by ordinary mail, electronic mail or fax.
